Is Cliven Bundy Right?

Well not about that idiot thing he said when he started off with the words “I want to tell you one more thing I know about the negro...”  When I was studying legal history I called this kind of crud “cringe quotes” where you would be reading a perfectly fine speech by Lincoln about human freedom and then he would say something incredibly racist.  There has been some attempt to rehabilitate what he said, such as here, but at best it only mitigates what is still a pretty racist and ignorant thing to say.  No, there is zero chance that black people were better off under slavery and you have to be willfully ignorant of the evil of slavery to even entertain the thought.

The significance of his dumb remarks is that he doesn’t have a future as the leader of a movement.  Instead he should be treated as just one guy with a complaint that may or may not be just.  Or to quote Gavin McInnes:

At any rate, as Dana [Loesch] points out, this isn’t about some old guy’s views on slavery. It’s about government control. We’re not saying Bundy is the messiah and we accept him as our personal savior. We’re saying the government is wrong.

And that has to be the principle here.  If I can defend the freedom of speech of a guy who cheered on Brett Kimberlin’s suppression of my own speech, I can defend a racist’s claim to grazing rights.  When it comes to the legal issues his racism is beside the point.  If a government lawyer brought it up in court, it would annoy the judge by being irrelevant. Or to quote from Mark Steyn:

the reason the standard representation of justice in statuary is a blindfolded lady is because justice is supposed to be blind: If you run a red light and hit a pedestrian, it makes no difference whether the pedestrian you hit is Nelson Mandela or Cliven Bundy. Or at least it shouldn't: one of the basic building blocks of civilized society is equality before the law.

So like Steyn I will stipulate that Bundy is wrong on racial issues and slavery and it doesn’t mean a damn in regards to his dispute with the Bureau of Land Management.  But is he right in his dispute with the Bureau of Land Management?

BREAKING: Blowback for Convicted and Admitted Document Forger Brett Kimberlin in the RICO Suit?

This is the latest post in what I half-jokingly call The Kimberlin Saga®.  If you are new to the story, that’s okay! Not everyone reads my blog.  The short version is that Kimberlin has been harassing me for over two years, his worst conduct being when he attempted to frame me for a crime.   I recognize that this might sound like an incredible claim, but I provide video and documentary evidence of that fact; in other words, you don’t have to believe my word.  You only have to believe your eyes.  And more recently when his wife came to us claiming that this convicted terrorist had threatened her harm, we tried to help her leave her, and for that, he is suing myself, John Hoge, Robert Stacy McCain and Ali Akbar for helping his wife and he is suing Hoge, McCain, Akbar, DB Capital Strategies, Michelle Malkin, Glenn Beck, James O’Keefe III, Patrick “Patterico” Frey, Mandy Nagy, Lee Stranahan, Erick Erickson, Breitbart.com, the Blaze, Mercury Radio Arts, Red State, the National Bloggers Club, and  Simon and Shuster alleging that we are all in organized crime for reporting factually about the spate of SWATtings committed against myself, Frey and Erickson.  So, if you are new to the story, go to this page and you’ll be able to catch up on what has been happening.

Dear reader, this is a supplemental post to yesterday’s post on the hearing where Brett admitted to a second act of document forgery.  Normally I just report and figure my reputation is good enough.  Seriously, although Schmalfeldt has repeatedly called me a liar in my legal reporting has he ever produced a transcript that showed I lied about what went on in a hearing?

But in this case it is worth transcribing large portions of the audio because... well, it’s just good stuff.  And by the way, this is also a way of mass communicating this data to my co-defendants.  And while we have ordered a transcript and I suspect it will be posted when it is available, it is just too juicy to wait.

Convicted Terrorist Brett Kimberlin’s Attempt to Save his Second Amended (RICO) Complaint

Earlier I shared with you happenings in the state case, and I will talk more about it, soon, but things have happened in the Federal case, too.  As you might recall, Brett filed a motion to amend the complaint.  I filed an opposition, here, as did Mr. Hoge, Dan Backer and DB Capital Strategies, and Michelle Malkin and Twitchy.  Brett could have filed at least four different responses and go into a lot of detail, but instead he decided to whine and spit venom for only one omnibus response, which has been published at Hogewash.  So go read it already and then come back.  We’ll discuss.

So he starts right off by being dishonest, writing in ¶ 1:

In short, [the objecting defendants] argued that Plaintiff failed to comply with Local Rule 103.6(c) by missing a few, non-prejudicial bolds and strike-throughs in the redlined copy he provided to them.

By way of background, that rule requires that when you file an amendment to a complaint you provide also a “redline” copy of it showing all the changes that were made.  The purpose of that rule is obviously to aid us and the court in determining whether his amendments were sufficient.

So as you might have seen over at Hogewash or the Other McCain, Brett Kimberlin had a terrible no good very bad day in court today.  On the docket were three motions for sanctions.  The first two were Brett’s.  One was against Patrick Ostronic claiming that Akbar is not a Virginia resident (and as I understand it, Ali isn’t a resident of the Commonwealth).  The second was against me for filing a motion in as another party in support of Kimberlin Unmasked.  Both of those were so frivolous that Brett voluntarily withdrew them at the beginning of the hearing.

This was not the case for our attorney, Patrick Ostronic, Esq. seeking sanctions for the alteration of a certified mail green card.  To see an example of the crushing evidence against Brett on this point, go here.  Namely he keeps adding a checkmark to the green card indicating restricted delivery, after it had been sent and returned without that option chosen.  This is important because under Maryland law, the initial service has to be restricted delivery—that is, they want to make extra sure you actually know about the suit before they can do things like find you in default judgment if you don’t respond.

Judge Joan Ryan presided.  Brett showed up looking entirely too casual, with hair that had overgrown into an ugly mullet, a suit but no tie, and loafers with white socks.  Also he wore a Yale jacket as an overcoat when he came in, probably as a way of irritating me since I actually graduated from their law school, or something.

“His Sacrifice Loaned me the Rest of My Life:” A Ft. Hood Soldier Speaks Out in Favor of Arming Soldiers on Base

“[H]is sacrifice loaned me the rest of my life to tell this story.”  That is the stunning and condemning words of 1st Lt. Patrick Cook of the 49th Transportation Battalion, Ft. Hood, Texas telling us how Sgt 1st Class Daniel Ferguson held the door shut, keeping his fellow soldiers safe as Spc. Ivan Lopez tried to get in, with murder in his mind.  Fergusson was fatally wounded but despite that fact he was able to hold the door shut and save everyone inside.

This was all during the second Ft. Hood massacre.  Let me say that again for emphasis: the second Ft. Hood.

When they were holding the trial for the first Ft.
